190 ملین پاؤنڈ کیس؛ عمران خان اور بشریٰ بی بی نے ہائیکورٹ کا فیصلہ چیلنج کر دیا

پاکستان تحریکِ انصاف (پی ٹی آئی) کے بانی اور سابق وزیرِ اعظم عمران خان اور ان کی اہلیہ بشریٰ بی بی نے 190 ملین پاؤنڈ کیس میں اسلام آباد ہائیکورٹ (IHC) کے اس حکم نامے کو چیلنج کر دیا ہے جس میں وکلاء کو دلائل دینے کے لیے "آخری موقع" فراہم کیا گیا تھا۔ فریقین نے اس عدالتی فیصلے کو سخت، بلا جواز اور غیر منصفانہ قرار دیا ہے۔

اسلام آباد ہائیکورٹ کے چیف جسٹس سردار محمد سرفراز ڈوگر اور جسٹس محمد آصف پر مشتمل ڈویژن بینچ نے 15 مئی کو ایک تحریری حکم جاری کیا تھا، جس میں وکلاء صفائی کو 20 مئی تک دلائل مکمل کرنے کی حتمی مہلت دی گئی تھی۔ عدالت نے بار بار التوا مانگنے پر تشویش کا اظہار کرتے ہوئے خبردار کیا تھا کہ کیس کی حساسیت کے پیشِ نظر مزید تاخیر برداشت نہیں کی جائے گی۔

عدالتی حکم نامے پر اعتراض اٹھاتے ہوئے بیرسٹر سلمان صفدر کے ذریعے اسلام آباد ہائیکورٹ میں متفرق درخواستیں دائر کی گئی ہیں۔ ان درخواستوں میں مؤقف اختیار کیا گیا ہے کہ عدالت کا یکطرفہ حتمی ڈیڈ لائن دینا حقائق کے منافی ہے۔ درخواست میں واضح کیا گیا کہ 19 مارچ 2025 سے لے کر 30 اپریل 2026 تک دفاعی فریق کی جانب سے ایک بار بھی التوا کی درخواست نہیں کی گئی، اور 7 مئی کو مانگی گئی پہلی مہلت انتہائی ٹھوس وجوہات پر مبنی تھی۔

دائر کردہ درخواستوں میں جیل سپرنٹنڈنٹ کے رویے پر بھی سنگین سوالات اٹھائے گئے ہیں۔ عمران خان اور بشریٰ بی بی کے وکلاء کا کہنا ہے کہ جیل انتظامیہ غیر قانونی طور پر وکلاء کو اپنے موکلین سے ملنے کی اجازت نہیں دے رہی، جس کی وجہ سے کیس پر تفصیلی مشاورت معطل ہے۔

مزید برآں، درخواست گزاروں کا کہنا ہے کہ وہ ہائیکورٹ کے 30 اپریل کے فیصلے کے خلاف سپریم کورٹ جانے کا حق رکھتے ہیں، لیکن جیل حکام وکالت نامے (پاور آف اٹارنی) پر عمران خان اور بشریٰ بی بی کے دستخط کروانے میں رکاوٹیں کھڑی کر رہے ہیں۔ عدالت سے استدعا کی گئی ہے کہ وہ جیل حکام کو فوری ملاقاتیں کروانے اور قانونی دستاویزات پر دستخط کی سہولت فراہم کرنے کا حکم جاری کرے۔

یاد رہے کہ گزشتہ سال جنوری میں احتساب عدالت نے 190 ملین پاؤنڈ اسکینڈل کیس میں بانی پی ٹی آئی عمران خان کو 14 سال اور ان کی اہلیہ بشریٰ بی بی کو 7 سال قید کی سزا سنائی تھی۔ دونوں رہنماؤں نے اس سزا کے خلاف اسلام آباد ہائیکورٹ میں اپیلیں دائر کر رکھی ہیں، جن پر سماعتیں اب ایک اہم ترین مرحلے میں داخل ہو چکی ہیں۔

عدالت کی جانب سے دی گئی 20 مئی کی ڈیڈ لائن کے باعث اب سب کی نظریں اس بات پر ہیں کہ ہائیکورٹ ان نئی متفرق درخواستوں پر کیا فیصلہ سناتی ہے۔

£190m Case: Imran Khan Challenges IHC's 'Final Opportunity' Order

Former Prime Minister Imran Khan and his spouse Bushra Bibi have legally challenged the Islamabad High Court's (IHC) order that granted a "final opportunity" for arguments in their ongoing appeals against convictions in the £190 million case. The petitioners termed the court's strict deadline as harsh, unjustified, and unfair.

The IHC's Strict Stance

On May 15, an IHC division bench comprising Chief Justice Sardar Muhammed Sarfraz Dogar and Justice Muhammad Asif issued a written order setting a final deadline of May 20 for the defense counsel to present arguments, warning against further delays. The court expressed dissatisfaction over previous adjournment requests, noting that the case required progress due to its sensitive nature.

Objecting to this, Barrister Salman Safdar filed miscellaneous applications on behalf of the petitioners, stating that the deadline did not align with the factual history of the proceedings. The pleas maintained that no adjournment had been sought by the defense from March 19, 2025, to April 30, 2026, and that the request on May 7 was based on genuine grounds.

Accusations Against Jail Authorities

The newly filed applications leveled serious allegations against the jail administration, claiming that the jail superintendent has unlawfully denied meetings between the petitioners and their legal team. This has reportedly disrupted necessary legal consultations.

Furthermore, the defense stated that they intend to challenge the IHC's April 30 decision before the Supreme Court, but jail authorities have failed to facilitate the signing of the 'vakalatnama' (power of attorney). The pleas urged the high court to direct jail officials to urgently arrange meetings and ensure the signing of the required legal documents.

Case Background

In January last year, an accountability court in Islamabad convicted Imran Khan and Bushra Bibi in the £190 million case, sentencing Khan to 14 years in prison and his wife to a seven-year jail term. Both later challenged the verdict in the IHC, where the appeals are currently being heard.

With the court's May 20 deadline looming, all eyes remain on how the IHC will address these fresh miscellaneous pleas.
